The following General Terms and Conditions (GTC) apply exclusively to any legal relationship between Leipziger Schlüsseldienst and its customers. These GTC are an integral part of every contract between Leipziger Schlüsseldienst and its customers. Whenever an order is placed, the customer is made aware of the following GTC. These GTC take precedence over any conflicting terms and conditions of the customer. By signing, placing a phone call, or making contact in any other manner (Messenger, SMS, WhatsApp, etc.), the customer confirms that they are aware of these GTC and thereby accepts and confirms them.

The Terms and Conditions apply to both business and individual customers.

Any conflicting terms and conditions of the customer are rejected. If the customer wishes to apply conflicting terms and conditions, these must be communicated in writing to Leipziger Schlüsseldienst prior to placing the order and must be approved in writing by Leipziger Schlüsseldienst.

German law applies to the conclusion of contracts.

The official language is German.

The Formation of the Contract.
A contract with Leipziger Schlüsseldienst is concluded either by telephone (telephone contract) or through a written order confirmation sent by mail, fax, email, or other means of communication (Messenger, SMS, WhatsApp, etc.) from Leipziger Schlüsseldienst.

Leipziger Schlüsseldienst reserves the right to decline orders that have not yet been confirmed without providing a reason.

Any verbal changes to orders that have already been confirmed, made by the client, will only take effect if they are submitted in writing by the client and confirmed in writing by Leipziger Schlüsseldienst.

Verification of identity when opening doors, windows, cars, vehicles, and buildings
The technician is entitled to request proof from the customer that they are authorized to have the property opened. This proof may be provided in the form of an official identification document (national ID card or passport, vehicle registration) showing an address, or through a neighbor’s testimony. If proof of identity cannot be provided, the technician may, at his or her discretion, contact the authorities (the municipal public order office or the police) to verify the customer’s identity or refuse to open the property altogether.

Liability for Door Unlocking, Emergency Unlocking, Car Unlocking, and Vehicle Unlocking
The technician informs the customer that the various opening methods may result in consequential damage to the object being opened. If the customer was assured (e.g., by phone) prior to placing the order that the object could be opened without causing damage, but this later proves to be impossible, the technician is obligated to consult with the customer before any damage occurs and to inform the customer of any potential consequential damage. Liability for any damage resulting from the opening process is generally excluded, unless it can be proven that the technician acted intentionally. If an object to be opened is additionally secured, locked, damaged, or cannot be opened non-destructively, it will be opened by force—and likely not non-destructively—at the customer’s express request. The customer hereby expressly waives any claims for damages of any kind, as he has expressly consented to this method of opening. If the customer expressly states that they object to the liability clause, the technician is obligated to refrain from performing the emergency opening and, at their discretion, to bill the customer for a no-service call.

Regardless of the legal basis, Leipziger Schlüsseldienst is liable for damages only in cases of willful misconduct, gross negligence, or the absence of a warranted characteristic. This also applies to agents and legal representatives of Leipziger Schlüsseldienst.

Prices and Services
Unless otherwise agreed upon in an individual contract, the prices of Leipziger Schlüsseldienst in effect at the time the contract is concluded shall apply to the contracts. Unless otherwise agreed, the prices agreed upon in the order shall apply. Exceptions will be discussed with the customer on site. The technician strives to open locks professionally, as quickly as possible, and with minimal damage. Unless otherwise specified, the currency used is the euro. This also applies in cases where no currency is specified.

Special Orders, Keys, Lock Systems, and In-Store Sales
The Leipzig Locksmith Service reserves the right to make up to three attempts to correct the issue in the event of a complaint. A claim for a refund is excluded if the customer procures the blank keys themselves; submits broken or bent keys as samples; the key has coding or an immobilizer; or the sample key submitted is no longer an original. Locking systems must be checked for all locks and quantities before placing an order; any changes must be communicated in writing. Returns are not permitted. Opened merchandise must be purchased and cannot be exchanged. Discounted and/or custom-made customer merchandise is excluded from exchange or return.

Terms of Payment
Payment is due immediately after the service is rendered, in cash or by card (according to Sumup, all major debit and credit cards are accepted) on site. Payment by invoice always requires prior written agreement. In the event that the order is not carried out—despite the service provider having already begun or completed the trip—due to a failed identity verification, the customer’s explicit objection to the liability clause in these Terms and Conditions, or any other failure to carry out the order for which the customer is responsible, the customer will be charged a fee of 35 EUR for an empty trip from Monday through Friday between 8:00 a.m. and 8:00 p.m. For the periods Monday through Friday from 8:00 p.m. to 8:00 a.m., on holidays, Saturdays, and Sundays, a fee of 45 euros will be charged for an empty trip. Invoices are payable immediately without deduction. Unless otherwise agreed, any remaining amounts must be transferred to the checking account of Leipziger Schlüsseldienst within ten business days. The deduction of a cash discount requires a specific written agreement. Business customers will receive an invoice, which is payable immediately without deduction. If a customer is in default of payment, either in full or in part, we will generally send a reminder after 10 days. If the customer is still in default after an additional 6 days, we will transfer our claim to a collection agency or attorney for further processing, which will result in additional charges for the customer. Insolvency must be reported immediately upon recognition, within the applicable time limits. Leipziger Schlüsseldienst is entitled to charge default interest at an annual rate of 5% above the ECB’s base rate from the date of default, unless Leipziger Schlüsseldienst can prove that the actual damages were higher. Leipziger Schlüsseldienst reserves the right to require payment in advance and to provide services only after receipt of the invoice amount.

Delivery Time
Leipziger Schlüsseldienst will make every effort to meet the agreed-upon delivery dates; however, Leipziger Schlüsseldienst does not guarantee this. The customer may only claim damages for delayed or failed deliveries if the Leipzig Locksmith Service is found to have acted with intent or gross negligence. If the Leipzig Locksmith Service is unable to meet the delivery deadline due to unforeseen circumstances beyond its control that cannot be averted with the diligence of a prudent businessman (force majeure or supplier issues), the delivery date shall be extended appropriately by the duration of such obstacles, provided that the service is not permanently impossible. Should a service be permanently impossible, the Leipzig Locksmith Service reserves the right to cancel the service itself.

Retention of Title
The goods remain our unrestricted property until full payment has been made. Should any claims for damages, warranty, or other matters arise prior to full payment, these shall be borne by the customer.

Warranty and Guarantee
We provide the statutory warranty period for goods, effective from the date of purchase. The warranty covers defects in the item, but does not cover wear and tear, damage caused by the customer’s own negligence, or improper use of the item or its components. Damage caused by third parties, burglary, vandalism, acts of violence, natural disasters, and war is excluded from exchange. Custom-made items are generally excluded from exchange.

Subcontractor
Among other things, we work as subcontractors for other companies. If you have any questions or complaints, or if you wish to file a claim for damages, please contact the contracted company directly.

Place of Jurisdiction
The place of jurisdiction is Leipzig. However, the Leipzig Locksmith Service is also entitled to assert claims against the client in any other court with jurisdiction over the matter.
Company Location, Headquarters, and Website The Leipzig Locksmith Service is headquartered in Leipzig at Kurt-Eisner-Straße 56, 04275. The owner is Sven Seiler. The websites are www.schluesseldienst-leipzig.de or www.leipziger-schluesseldienst.de and are provided for informational purposes only. They do not constitute a contractual basis. Shipping, Services, Transfer of Risk, and Acceptance Shipping is from the distribution warehouse. Leipziger Schlüsseldienst is entitled to make partial deliveries and provide partial services. In all cases, risk passes to the customer upon shipment. At the customer’s express request and for goods valued at over 500 euros, Leipziger Schlüsseldienst will ship the goods with insurance coverage. Shipping costs will be billed to the customer. Shipping is at our discretion. Claims for obvious defects are excluded unless they are reported in writing immediately upon arrival of the goods or completion of the work at the destination. Leipziger Schlüsseldienst reserves the right to ship orders cash on delivery without prior notice. Severability Clause: Should one or more provisions of these General Terms and Conditions be or become legally invalid, the remaining provisions shall remain unaffected.
